Terms and Conditions
Last revised: 25/5/08
By accessing or contributing to this web site, currently located at www.AUScenery.com (the "site") and owned by AUScenery Gallery ("www.AUScenery.com", “AUScenery.com “, "We", “our” or "us", as appropriate), the contributor of this site and any individual or entity on whose behalf a contributor accesses or uses the site (collectively, “the contributor”, "you" or "your," as appropriate) agree to be bound by the following Terms and Conditions. Please read the following notes carefully and often as they are subject to change. Your continued use of the site after the posting of changes to these Terms and Conditions constitutes acceptance of the changes. If you do not agree to these Terms and Conditions, do not use the site.
1. Image subjects
- Australian landscape and scenery
- The features like constructions, fauna, flora, human figures may also be included provided that they help to portray the place to be captured. If in doubt, please submit your images for our determination.
- Your submitted images must not show or imply any negative image / messages to Australia in any forms. Do not forget this site is for promoting the beauty of Australia and its tourism. AUScenery.com reserves the rights to reject those unqualified images.
2. Copyright, photographic permit and model/building release
- You must hold the current and valid copyright of your submitted images. You retain copyright to images and text uploaded to AUScenery.com.
- If your images involved any photographic permits or model/building releases or equivalent, it is your responsibility to organise such requirements. AUScenery.com reserves the rights to remove your images if being approached and queried by the related parties or government bodies unless a record of photographic permits or model/building releases or equivalent can be presented by you.
3. Image usages
- By submitting your images, you grant AUScenery.com and its successors to use and modify the accepted images on www.AUScenery.com including gallery, slideshows, banners, thumbnails and videos hosted on www.YouTube.com. Credit will be given where it is deemed to be appropriate. For promotional printing material (for example, exhibition leaflet), we will consult you first before use.
4. Image preparation before submission
- .jpg only
- 512 pixels for the longest side with no more than 100K file size per image. Although it is not compulsory, we recommend 700 pixels for the longest side for panoramic images with the ratio of 1:2+ image resolution.
- Plain images with no border, matt, watermark, name and logo. For credit to you, a photographer link (underlined) will be displayed next to each image such as “Circular Pool, Karijini NP, © Pele Leung”. Clicking this link will bring up a separate window for your portfolio page on this site.
- Image file naming convention is important for categorising and detailed guidelines will be given when joining us.
5. Image acceptance
- We only need 'high quality' images but this definition is always debatable. The general guidelines are (a) technical competence – appropriate sharpness and exposure (b) pleasant to viewer. There are a lot of examples in our gallery for your reference. Send us your samples if you are in doubt.
- As this site is mainly for tourism, we only accept realistic images with reasonable manipulation.
- No limit will be set for the number of accepted images but we reserve the right to reject unqualified images.
6. Image submission
- A password-secured gallery utility is used for image submission. Your submitted images will be evaluated and posted on our gallery and your own portfolio on our site if they are accepted. We will notify you the submission result by email. Details of submission operation will be given when joining us.
7. Joining, withdrawing and membership
- Your first joining is free but we will charge you a small fee for subsequent rejoining (i.e. join-withdraw-rejoin).
- For withdrawal, apart from the images already being used in our videos, all images previously submitted by you will be removed from the AUScenery.com website and all our backups. This is important to everybody's concern of image security.
- At this stage, no annual membership fees will be charged
8. Photographer's portfolio
- A portfolio will be created on our site for you as soon as you have at least one accepted image. This portfolio will be stored on a separate page with photographer's Bio, web link to your own website, contact email and gallery/slideshow facilities for your accepted images.
- A featured photographer will be highlighted periodically on the front page of our site (duration to be determined) and the selection is based on the quality and size of the portfolio. This is another great opportunity for maximising the exposure of your work.
9. Selling prints on behalf of the contributors
If you are interested in selling your images as fine art prints, we can provide the following services:
Handle the whole transaction for you:
- Answer order enquiries
- Communicate with you to determine the print price (or use our standard price scheme). Minimum price will be set.
- Once an order is confirmed, we will handle payment, printing, delivery and wire transfer your share to your bank account.
- Initially we can do A4 and A3 prints using Ultrachrome pigment ink Epson printer.
- Commission rate to be advised.
OR
Direct the order enquiries to you:
We will simply direct the enquiries to you without charge. In other words, you will have to handle the whole process yourself including price negotiation, payment transaction processing, printing and delivery.
10. Joint venture products and exhibitions
- We aim to produce a series of tourism products such as DVDs and books. If your images have been selected, we will notify you the terms and conditions separately.
- Gallery exhibitions provide a good channel to promote AUScenery.com and yourself. It is our aim that your exhibition expenses could be earned back via the on-location sales of your prints or product. We will provide you with more details when this event comes up.
11. Promotion
Instead of setting up the site and waiting for visitors and sales, we will actively promote and advertise AUScenery.com via various channels. We will not pass any advertising expenses to our contributors and this is one of the major differences between some portals and us.
Joining us
If you are interested in joining us, please email contributor@auscenery.com your web site address or your portfolio location on Internet for image quality evaluation. Alternatively you can email us your best 10 photos according to our image requirements mentioned above.
